Material and Labor Warranty-Ten Years
From Weatherproof, Inc. to building owner.
Warranty Includes all Material and Labor

Coverage
Weatherproof, Inc. warrants these roof materials against defect for ten (10) years from the date of application provided said materials are applied in strict accordance with Weatherproof, Inc. printed instructions over a clean, dry, sound substrate and are used under conditions of ordinary wear.  If water leakage should occur within the warranted ten (10) years, Weatherproof, Inc. will provide replacement material to repair leakage, and all labor replacing said material.

Exclusions
This warranty shall not extend to any defects or failure of the materials resulting from: A-Natural occurrences such as, but not limited to, lightning, hurricanes, fall gales, earthquakes, floods, tornadoes and falling objects.  B-Damage to the structure, property or contents or the building caused by settling, cracking, movement, shifting, distorting or splitting. C-Failure of underlying architectural  components such as decks, drains, roof vents, insulation, flashing, parapet walls, etc. D-Ponded water. E-Any deliberate act of negligence of the purchaser or other person in maintaining surfaces to which materials have been applied. F-Damage caused by change in building use, new additions to, through or adjacent to said materials, any repairs or changes to coated surface or materials after effective date of warranty without prior written consent from Weatherproof, Inc. G-Accumulation of dirt or other particles causing discoloration, change in appearance of materials. H-Weatherproof, Inc. shall not be liable for any damage causing loss of profits, rents or substrates coated with said materials.

Notification of Claim
Owner shall notify Weatherproof, Inc. of any leaks on coated roofs within 30 days of occurrence, confirming such notice in writing.  Weatherproof, Inc if necessary, will arrange for roof of surface inspection. If the cause of leakage is covered in this warranty, Weatherproof, Inc. will provide product replacement and labor for affected areas.  Weatherproof, Inc. will not be responsible for any leakage not covered in this warranty.

Counterparts
This warranty may be signed in counterparts, each of which shall be deemed an original.

Governing La/Venue
This warranty shall be governed by the laws of the States of Florida. The parties consent and agree that the sole venue for any action or proceeding concerning this warranty or the matters contemplated hereby shall be in Florida state court located in Seminole County, Florida.

Entire Agreement
This warranty constitutes the entire indivisible agreement between the parties here to regarding the subject matter hereof and replaces all prior negotiations, memoranda and agreements, written or oral.

Unauthorized Repairs
Necessary repairs caused by alterations, additions or extensions made at owner's expense will not void this warranty provided by the owner: Contacts Weatherproof, Inc. before repair work is made and performs repair work recommended by Weatherproof, Inc. If such repairs are made promptly by the owner, according to specifications and procedures recommended by Weatherproof, Inc. the warranty will remain in effect for the unexpired portion of its original term.  This warranty will be automatically terminated with respect to the affected area, if the owner disregards Weatherproof, Inc. recommendations.

Liability Limitations
Weatherproof, Inc. warranty shall be limited to supplying enough materials to effect the replacement of such materials determined by Weatherproof, Inc. to be defective and all labor to replace said material.

Requirements
Owner must have the metal roof covered under this warranty pressure cleaned three (3) times during the life of this warranty.  Weatherproof, Inc. will provide instructions to Owner as to how to pressure clean the affected roof so as not to cause damage to the repair work performed by Weatherproof, Inc.

Warranty Limitation
This warranty is nontransferable and effective only with the original owner.
